Gays for Lisbon

There are many reasons why I shall endorse the Lisbon Treaty and the guarantees agreed to by Europe on the 2nd of October. Many of them are listed in a deliciously tongue in cheek manner here.

However, this entry shall attempt to outline, why I, as a gay man, am backing the motion.

The reasons for being a pro EU gay are multiple. Everyone is fully aware of the fabled Norris V Ireland case that brought us one giant leap closer towards equality in the late 1980s. It is still somewhat astonishing to see the look of wonder on a continental European’s face when you tell them your sexual orientation was illegal in your country as late as 1993.

Then there’s the slightly lesser known case of one Rocco Buttiglione, who, in 2004 was Italy’s nominee to be a European justice commissioner. The fact that our Rocco was frequently quoted as saying homosexuality was a sin caused the European Parliament to flex its democratic muscle in defence of equality and core European values and eventually ensure that Italy nominated someone else instead.

But again, I’m dancing around the issue at hand – Lisbon. The opening few pages of the treaty are positively littered with references to sexual equality most of which have their origin in previous treaty’s but are, of course, no less relevant today.

The text also gives legal recognition to the Charter of Fundamental Human Rights. Under article 20 of which “any discrimination” on the grounds of sexual orientation or otherwise is strictly prohibited.

In a more roundabout way, the treaty also allows for further European expansion. EU law now says that any would be member has to have fully legalised homosexuality and have legislation in place that protects its citizens on grounds of sexual orientation in both public and private sector employment. This has been a lifeline to gay communities up and down Eastern Europe in the past few years.

As a footnote the rules outlined above would deem both the United States and Russia ineligible for EU membership at the moment.

Its quite sad that you only take the gay context from the Lisbon Treaty and not the bigger picture. This treaty is self ammending, EU justice law will over-ride national law, it allows for a President of Europe unelected by the people, or the parliment, but elected by the unelected EU Council. It is probably the most undemocratic document the EU has ever produced. It is the former EU constitution with minor word changes to disguise it as a treaty. It is so complicated and open to interpretation, its frightening. We're are being told by our government that it is a vote for our place in Europe. It seems if anyone disagree's with the EU you become Anti-Europe. We are voting again on exactly the same text, nothing is different. The guarantees are only clarifying certain aspects of the treaty. I have done so much research into this treaty and still continue to do so. It is claimed that this treaty is designed to streamline the EU decision making process. Whilst I have you though, I must highlight some things in your arguments. 1) The Treaty is NOT self amending. It may be amended by convention. Which means that should the EU Council seek to change anything they must first ask parliament and the commission and then all the Parliaments across the EU states. Should there be no disagreement, a convention may be established containing representatives from civic society all over Europe. Should they agree on any changes that impinge on our constitution a referendum, as always, MUST be called. 2)Thankfully EU law has had precedence since the 70s. That's why women have equal pay 3)The EU council is elected. It consists of the heads of governments which in democracy's are elected. 4) It's quite a democratic document. Giving the directly elected parliament power in 19 new areas. 5) This is quite a different deal to last time. This time every country shall appoint a commissioner. That's right Steven. Though individual states in the US have the laws and protections in place required for the LGBT community for EU membership, the federal government as a whole for membership. Thanks for reading.
