Japanese Trans Father Unrecognised
A 27 year-old trans man who had the child with his wife, he will not be recognised as the father.
It is rumoured that the young man will be appealing this decision at Kobe family court.
His wife gave birth to their child in 2008 after he was conceived using the sperm of the young man’s brother shortly after he transitioned.
When trying to register the child as his son, this man was told by officials in Shiso, Hyogo Prefecture, that the child would be registered as illegitimate, although he is legally recognised as a man.
It was the Justice Ministry who made the decision, basing it on the grounds that a couple of the same gender cannot have a child. This is despite the 2004 law which allows people to be legally recognised in their acquired gender.
Couples where one partner is trans have instead been encouraged to adopt their children to ensure inheritance among other rights.
